Terms of Service
Last updated: July 4, 2026
Acceptance of Terms
By accessing or using Virtual ER's telemedicine services, website (virtualers.com), or any related services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.
Description of Services
Virtual ER provides telemedicine consultations with board-certified emergency physicians via video. Our services include medical evaluation, diagnosis, treatment recommendations, prescription services, specialist referrals, and coordination with our affiliated physical emergency room at 5306 Bellaire Blvd, Bellaire, TX 77401.
Not a Substitute for Emergency Services
Virtual ER telemedicine is not a substitute for 911 emergency services. If you are experiencing a life-threatening emergency — including difficulty breathing, chest pain, uncontrolled bleeding, signs of stroke, or loss of consciousness — call 911 immediately. Do not delay emergency care to schedule a telemedicine visit.
Eligibility
You must be located in the state of Texas at the time of your telemedicine visit. Our physicians are licensed to practice in Texas. Services for minors require the presence and consent of a parent or legal guardian.
Patient Responsibilities
You agree to:
- Provide accurate and complete information about your identity, medical history, and current symptoms
- Follow the treatment plan recommended by your physician
- Seek immediate in-person emergency care if directed to do so by our physician
- Maintain a stable internet connection for video consultations
- Not record telemedicine consultations without the express consent of the treating physician
Payment and Billing
Payment is due at the time of service unless covered by insurance. We accept major credit and debit cards. Insurance coverage and copay amounts vary by provider and plan. For billing inquiries, contact us at 1-855-FIND-VER or info@virtualers.com.
Prescriptions
Our physicians may prescribe medication when medically appropriate. Prescriptions are sent electronically to the pharmacy of your choice. Certain controlled substances may not be prescribed via telemedicine and may require an in-person evaluation.
Limitation of Liability
Telemedicine has inherent limitations. Our physicians make clinical decisions based on the information available during the consultation. Virtual ER and its physicians are not liable for outcomes resulting from incomplete or inaccurate information provided by the patient, failure to follow medical advice, or the inherent limitations of remote medical evaluation.
Intellectual Property
All content on the Virtual ER website — including text, graphics, logos, images, and software — is the property of Virtual ER and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.
Privacy
Your use of Virtual ER services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
Changes to Terms
We may update these Terms of Service from time to time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
Governing Law
These Terms of Service are governed by the laws of the State of Texas. Any disputes arising from these terms or your use of our services shall be resolved in the courts of Harris County, Texas.
